We do. Our online shopping features may be hosted on the Shopify, Inc. ("Shopify") e-commerce platform, which facilitates the sale of our Merchandise to you. A. Personal Information.  

We collect certain PII or data about you, which may be supplied when visit the Sites, when you complete a survey, when you create or update an account, when you use the Apps, when you browse pages within the Sites, when you fill out a form available on the Sites, when you make a purchase via the Sites, or otherwise when you submit such information. The types of PII we collect and save include: 

  • Name, email address, mailing address, phone number, date of birth, employment information, and profile information (username, password, access/login log records);  

  • Purchasing history, account and communication preferences information;  

  • Any personal information you disclose to us in your communications to us; and 

  • Technical information collected in our logs. Such information may include standard web log entries that contain your device identifiers, cookies (first-party, third-party, session, and persistent), web beacons, pixels, page URL, and timestamp. 

You may provide us with information when you interact with us through email or otherwise when you interact with us. We may retain such information in order to provide you with the Service, and you agree that we may share this information as needed with other users in order to resolve any issues that may arise between you and another user of the Service. 


B. Non-Personal Information.  


“Non-Personal Information” is information which doesn’t identify you and/or anonymous information about you, including but not limited to links and materials posted, enrollment history, purchase history, the type of device you used and its operating system, browser information, the pages accessed most frequently, how pages are used, applications downloaded, search terms entered, when and how you use the Apps, and similar Non-Personal Information. 

Automatically tracking Internet Protocol (IP) addresses is one method of automatically collecting information about your activities online and information volunteered by you. An IP address is a number that is automatically assigned to your device whenever you surf the internet. Further, the Sites and Service may utilize web beacons, pixels, cookies, and other commonly used information gathering tools. Through collecting your IP address, we may be able to approximate your geographic location, however, unless and until this information is paired with your PII, it cannot be used to identify you. If Non-Personal Information is paired to any of your PII, we will treat the Non-Personal Information as if it was PII. 

Part of the purpose of the Sites is to share materials you make available. Anything you publicly post will not be considered PII. 

  1. Aggregate Information.  

We may also collect anonymous, non-identifying and aggregate information, such as the website you go to after visiting our Sites. 

  1. Financial Information

Although it may appear that we collect financial information from you on the Service, such as your credit card number and related information, it is actually collected and processed through a third-party service provider (“Payment Processor”) to process payments for the Service. The Payment Processor may collect financial information such as banking information, credit card number, name, CVV code, and/or Credit Card date of expiration, from you on the Service. We do not hold your financial information. 

Shopify retains and encrypts your financial information in accordance with the Payment Card Industry Data Security Standard (PCI-DSS). Such transaction records are preserved only for the duration required to finalize your purchase, after which they are purged. All direct payment gateways utilized by the Sites comply with the rigorous standards established by the PCI Security Standards Council—a collaborative effort involving brands such as Visa, MasterCard, American Express, and Discover. These PCI-DSS protocols are designed to safeguard the processing of financial information by the Sites and related service providers. 

  1. Why Is My Information Being Collected? 

We accept and gather information in an effort to provide better products and services to you. We collect your PII so that we can respond to your requests for information or so that you can be added to our email and SMS lists, we can curate a personalized experience for you with the Services, and for us to process any orders made in connection with the Service, and, to train, develop, and improve the artificial intelligence and/or machine learning models and algorithms that we may create or use (collectively, “Models”). We also collect aggregate information to help us better design the Sites. We collect log information to help us diagnose problems with our servers, administer the Service, calculate usage levels, and otherwise provide services to you.

For requests to access your PII that we have collected please send an e-mail to security@selkirk.com. To protect your privacy and security, we will take reasonable steps to help verify your identity before granting access, making corrections or removing your information.   1. How Do We Store and Protect Your Information? 

A. Storage

After receiving your PII, we will store it for future use. While we have appropriate safeguards in place, unfortunately, no data transmission over the internet or data storage solution can ever be completely secure. As a result, although we take steps to protect your data, we cannot ensure or warrant the security of any information you transmit to or receive from us or that we store on our or our service providers' systems. 

B. Server Locations

If you are visiting the Sites from outside of the USA, you understand that your connection will be through and to servers located in the USA, and the information you provide will be securely stored in our servers and internal systems located within the USA.

  1. Security

Please note that we protect PII in our possession with strong encryption (at rest and in transit); all data transfers are through secure http protocol, and as such are encrypted. We also restrict access to PII to key employees. Our Payment Processors are fully PCI compliant and encrypt all payment transactions using Secure Socket Layer technology.  

D. Retention.  

We will retain your PII for as long as is reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. We may retain your PII for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. 

We may store our logs and other technical records and any information entered into our Models (if applicable) indefinitely. 

  1. How Do We Use Cookies and Other Network Technologies? 

A. Cookies

To enhance your online experience with us, our web pages may presently or in the future use “Cookies.” Cookies are text files that our web server may place on your hard disk to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other PII unless you choose to provide this information to us. Once you choose to provide PII, however, this information may be linked to the data stored in the cookie. Although it may be possible to turn off the collection of Cookies through your device or browser, certain features of the Sites may not function properly without the aid of Cookies.

B. Third-Party Partner Services.

The Company or its service providers may also use “pixels,” “web beacons,” “clear GIFs” or similar means (collectively, “Pixels”) in connection with some of our Sites’ pages and HTMLformatted email messages for purposes of, among other things, compiling aggregate statistics about website usage and response rates. A Pixel is an electronic image, often a single pixel (1x1), that is ordinarily not visible to website visitors and may be associated with Cookies on visitors’ hard drives.   1. Clickstream Data

As you use the internet, you leave a trail of electronic information at each website you visit.   1. Opt-Out Preference Signal

  1. Text Message and SMS Marketing. 

If you choose, you can provide your mobile phone number to receive text message alerts from us to receive promotions, product announcements, and other marketing information from us. You agree, that by providing your mobile phone number, you expressly consent to receive automated text and SMS marketing messages from us to the mobile phone number that you provide. We may send you these messages from time to time, on a recurring basis, as promotions, announcements, and other marketing information become available. Opting-in or providing your consent to receive these messages is not required in order for you to use the Service generally. 

We may share your mobile phone number with service providers with whom we contract to assist us with the above activities, but we will not share your mobile phone number with third parties for their own marketing purposes without your consent. Text Messages are distributed via third party mobile network providers and, therefore, we cannot control certain factors relating to message delivery. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note, we may take additional steps to verify your information. 

J. Right to Appeal Any Denial of Your Rights. If we should deny your privacy right request, you may submit an appeal of that determination via email to security@selkirk.com.  In the subject line of your appeal email, please include the file number provided with the initial denial of your privacy right request and the word “APPEAL”. In the body of your appeal email please detail (1) the nature of your request, (2) your state of residence; and (3) your reasoning for why the initial denial should be reversed. In the event we deny your request for appeal, you may be able to file a complaint with the Office of the Attorney General in the State in which you reside, please consult the website of your applicable Attorney’s General for more information. 

  1. EEA Privacy Rights.  

If you are currently residing in the EEA and use the Service, the GDPR applies to your Personal Data, and you are a Data Subject. The GDPR requires that we, as a Controller, have a legal basis to process your Personal Data.  

A. Personal Data Processing

We process your Personal Data under one or more of the following legal bases:

  • The right to object. This is the right to object to further processing your Personal Data if such processing is inconsistent with the primary purposes for which it was collected. 

  • Rights in relation to automated decision making and profiling. This is the right to not be subject to a decision based solely on automated processing.  

  • Right to Judicial Remedy. Notwithstanding anything to the contrary in this Privacy Policy, if you feel that we or one of our processors, if any, have infringed your rights under the GDPR, or that we are otherwise not in compliance with the GDPR with respect to your PII, you may bring a legal proceeding against us in a court (or file a complaint with a supervisory authority) located in the EEA country where you regularly reside.

  1. Third Countries

In the event that we share, or otherwise transfer, PII covered by the GDPR and this Privacy Policy to a third party, or a country outside the EEA and/or UK, as applicable, which does not have an adequacy decision from the European Commission, or similar designation from the Information Commissioner’s Office, or similar regulatory authority (collectively, a “third country”), we will only do so if: (i) that third party, except in cases of government or law enforcement agencies, gives us contractual assurances that it will comply with the GDPR; and (ii) to the extent necessary, have in place a GDPR compliant procedure in place to protect the transfer, e.g. GDPR standard contractual clauses, available here, including any necessary assessments of the applicable third country, and supplemental measures designed to ensure you have essentially equivalent rights and remedies as you would in the EEA.

  1. California Consumer Privacy Rights. 

To the extent that the CCPA applies to the Service with respect to your Personal Information, and you currently reside in California, the CCPA provides you, as a Consumer, with certain rights (in addition to those found in Section 13 above, specifically, the rights to be informed, to access, to correction, automated decision making/profiling, and to portability). 

A. Right to Know

Consumers have the right to request that we disclose Personal Information we have collected about them in the previous 12 months including, but not limited to, the categories of information collected by us, the source(s) of such information by category, and the purpose for collecting such information. This right may not be exercised more than twice in a 12-month period. In the previous 12 months, we have collected the following categories of Personal Information about consumers: 

  • Identifiers. Identifiers can be your name, mailing address, social security number, unique personal identifiers (device identifier, IP Address, Cookies, beacons, pixel tags, mobile ad identifiers), account names, and similar information. We collect the identifiers from the consumers themselves and automatic means; 

  • California Customer Records (Cal. Civ. Code §1798.80) (“CCRLPI”). CCRLPI data is largely the same as Identifiers; 

  • Commercial Information. Commercial information includes records of personal property, products or services purchased, obtained or considered, or other purchased or consuming histories or tendencies; 

  • Geolocation Data. Such geolocation data may include GPS data, approximate physical location, and device location; 

  • Employment Information. Such employment information can include your employment history; 

  • Internet/Network Activity. Internet Activity Information includes browsing history, Cookies, search history and a consumer’s interaction with a website; and 

  • Non-public education information. Information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99). 

  • Inferences. Inferences drawn from any other category of Personal Information. 

We collect Personal Information in the above categories from the consumers themselves and by automatic means for the purposes described in this Privacy Policy, and as required to comply with applicable law. We do not collect Sensitive Personal Information as defined by the CCPA.  


B. Right to Know.  


As a Consumer, you also have the right to request that we tell you which of your Personal Information we have disclosed for a business purpose, Sold, and Shared (each, as defined in the CCPA) in the previous 12 months. With respect to Personal Information being disclosed for a business purpose, the consumer shall receive the categories of information disclosed and the types of entities they have been disclosed to. This right may not be exercised more than twice in a 12month period. For Personal Information being Sold or Shared this includes the categories of information being sold and the categories of third parties to whom it is being sold. In the past 12 months, we have disclosed and/or Shared Personal Information falling under the following CCPA categories:  

  • Identifiers; 

  • CCRLPI; 

  • Geolocation Data; 

  • Employment Information; 

  • Internet/Network Activity; 

  • Non-public Education Information; 

  • Sensitive Personal Information; and 

  • Commercial Information. 

We disclose and Share Personal Information in the preceding categories to the Consumers themselves (or their Parent, if applicable), to other users/third parties as the consumer may direct, and government/law enforcement agencies for the purpose it was provided/provision of Services, to comply with applicable law, and as otherwise described above in this Privacy Policy. 

IN THE PAST 12 MONTHS WE HAVE NOT SOLD, AND DURING THE PERIOD OF TIME WHICH THIS PRIVACY POLICY IS POSTED WE SHALL NOT SELL, THE PERSONAL INFORMATION OF ANY CONSUMER, INCLUDING MINORS UNDER THE AGE OF 16. 

C. Shine the Light

California law also allows its residents to request information regarding our disclosures to third parties in the prior calendar year, if any, of their personally identifiable information. To make such a request, please contact us at security@selkirk.com with “Shine the Light” in the subject line. Please include enough detail for us to locate your file; at a minimum, your name, email, and username, if any. We will attempt to provide you with the requested information within 30 days of receipt. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note that this law does not cover all information sharing. Our disclosure to you will only include information covered by the law. 

 

  1. Nevada Privacy Rights. 

If you are a Nevada resident, you have the right to opt-out of the “sale” of your “covered information” as such terms are defined in Chapter 603A of the Nevada Revised Statutes (“Nevada Privacy Law” or “NPL”). For the avoidance of doubt, we do not “sell” your “covered information”. Nonetheless, Nevada residents may submit a request to prohibit such sales by contacting us at security@selkirk.com. Additional information on the categories of personal information collected and categories of personal information shared with third parties can be found in this Privacy Policy. If you would like to tell us not to sell your information in the future, please email us at  security@selkirk.com with your name, postal address, telephone number, and email address with “Nevada Do Not Sell” in the subject line. 

  1. Texas Privacy Rights. 

If you are a Texas resident (“TX Consumer”) and use the Service, in addition to the rights described in Section 13 above, the Texas Data Privacy Security Act provides you with certain rights regarding your PII. As a TX Consumer, your Right to Delete in Section 13 includes any PII that we hold about you which you have provided to us and that which we have obtained from any other source. We will maintain a record of your deletion request and any minimum data necessary to ensure that your PII remains deleted. 

  1. Nebraska Privacy Rights. 

If you are a Nebraska resident (“NE Consumer”) and use the Service, in addition to the rights described in Section 13 above, the Nebraska Data Privacy Act provides you with certain rights regarding your PII. As a NE Consumer, your Right to Delete in Section 13 includes any PII that we hold about you which you have provided to us and that which we have obtained from any other source. We will maintain a record of your deletion request and any minimum data necessary to ensure that your PII remains deleted. 

  1. Changes to this Policy 

Because our business needs may change over time, we reserve the right to modify this Privacy 

Policy. If at any time in the future we plan to use your PII in a way that differs from this Privacy 

Policy, we will revise the Privacy Policy as appropriate. In the event of a change to this Privacy Policy, we will email the updated policy to the email address that you provided to us. Your continued use of the Service, or other means of legal acceptance, following our notice of changes to this Privacy Policy means you accept such changes. Please refer to the “Effective Date” above to see when this Policy was last updated.
