This Privacy Policy (the “Privacy Policy”) describes the types of information gathered by Selkirk Sport, LLC and its subsidiaries, including without limitation, Selkirk Sport OÜ, Selkirk Sport Malaysia BHD SDN, and PlayPickleball.com, Inc. (collectively “Selkirk,” the “Company,” “us,” “our,” or “we”) in the process of providing, running, and maintaining Selkirk’s websites, including: https://selkirk.com, (including subdomains such as https://partners.selkirk.com, https://asia.selkirk.com, and https://academy.selkirk.com),   https://selkirklabs.com, https://www.bnbpickleball.com/, https://getplaymore.com, https://playpickleball.com, and https://www.pickleballcoachinginternational.com (each a “Site” and, collectively, the “Sites”), our mobile/software applications (the “Apps”), our Models (as defined below), and the data, services, information, tools, functionality, updates and similar or related materials (collectively, the “Service”), how we use the information, with whom the information may be shared, what choices are available to you regarding collection, use and distribution of information and our efforts to protect the information you provide to us through the Service. This Privacy Policy applies to our Sites, Apps, Services and any other systems or websites that link to this Privacy Policy. 

By accessing the Sites, using the Service, or otherwise providing information to us, you hereby consent to allow us to collect, use, process, and disclose your information in accordance with this Privacy Policy. When accessing the Sites, please also refer to our Terms of Service, available here, https://www.selkirk.com/policies/terms-of-service, which are incorporated into this Privacy Policy as if fully recited herein. Terms defined in the Terms of Service that are not defined herein shall have the same definition as in the Terms of Service. In addition to the Terms of Service, each of the Sites may introduce other terms and conditions that you must agree to in order to use each applicable Site.

This policy is subject to change. If our information retention or usage practices change, we will let you know by posting the Privacy Policy changes on the Sites and/or otherwise making you aware of the changes. Your continued use of the Sites, or Service, following our notice of changes to this Privacy Policy means you accept such changes. Please refer to the “Effective Date” above to see when this Policy was last updated. 

While this Privacy Policy applies to each of the Sites, the scope of our data collection described in Section 7 may vary based upon which of the Sites you are accessing. You may exercise your rights described in this Privacy Policy in Section 13 by contacting security@selkirk.com.  

Territoriality 

Regardless of where our servers are located, your personally identifiable information, may be processed by us in the United States, where data protection and privacy regulations may or may not be to the same level of protection as in other parts of the world. BY VISITING THE SITES 

AND USING OUR SERVICES, YOU UNEQUIVOCALLY AND UNAMBIGUOUSLY 

CONSENT TO THE COLLECTION AND PROCESSING IN THE UNITED STATES OF ANY INFORMATION COLLECTED OR OBTAINED BY US THROUGH VOLUNTARY SUBMISSIONS, AND, TO THE EXTENT POSSIBLE, THAT U.S. LAW GOVERNS ANY SUCH COLLECTION AND PROCESSING. 

This Privacy Policy may be subject to the provisions of the EU General Data Protection Regulation ("EU GDPR"), the UK General Data Protection Regulation (“UK GDPR”, and together with the EU GDPR, the “GDPR”), the California Consumer Privacy Act of 2018, as amended (“CCPA”), the Malaysia Personal Data Protection Act (“PDPA”), and other applicable privacy laws. If you are an individual who resides in the United Kingdom, the European Economic Area, or Switzerland (collectively, and for the purposes of this Privacy Policy, the “EEA”), you are a “Data Subject” with certain protected privacy rights concerning your “Personal Data” and we are a “Controller” according to the GDPR. Similarly, under the CCPA, we are a “Business” and you, if you are an individual residing in California, are a “Consumer” with certain protected privacy rights concerning your “Personal Information.” We will take commercially reasonable steps to maintain compliance with GDPR, the CCPA, PDPA and all other applicable laws. Your Personal Data and/or Personal Information, combined with any other information that may identify you as a person, may be referred to in this Privacy Policy as Personally Identifiable Information (collectively, "PII"). If you are a Data Subject, read Sections 13 and 14 below, and if you are a Consumer, please read both Sections 13 and any section relevant to your state of residence, as applicable. For the purpose of this Privacy Policy, PII does not include de-identified or aggregated information that does not identify you. 

1. Collection, Use, and Disclosure Information.  

We may collect certain PII from you when you visit or browse our Sites or use our Service. It is important to note that the type of information collected will depend on your location and your interaction with the Service. 

1. Who Collects Your Information On Our Sites? 

We do. We collect information from you when you visit or browse the Sites, use our Apps or the Service, signup for our mailing list, sign-up to receive more information about the Company, or place an order. We are responsible for the protection of your information. We collect PII directly from you and from automatically collected information. 

Our online shopping features may be hosted on the Shopify, Inc. ("Shopify") e-commerce platform, which facilitates the sale of our Merchandise to you. Your PII is retained within Shopify’s databases, data storage systems, and the general Shopify application. Shopify and its third-party payment processing affiliates maintain this information on secure servers protected by firewalls. We disclaim all responsibility for Shopify’s privacy and data practices, and you acknowledge that you assume all inherent risks associated with using their platform.

1. What Information Do We Collect? 

A. Personal Information.  

We collect certain PII or data about you, which may be supplied when visit the Sites, when you complete a survey, when you create or update an account, when you use the Apps, when you browse pages within the Sites, when you fill out a form available on the Sites, when you make a purchase via the Sites, or otherwise when you submit such information. The types of PII we collect and save include: 

• Name, email address, mailing address, phone number, date of birth, employment information, and profile information (username, password, access/login log records);  

• Purchasing history, account and communication preferences information;  

• Any personal information you disclose to us in your communications to us; and 

• Technical information collected in our logs. Such information may include standard web log entries that contain your device identifiers, cookies (first-party, third-party, session, and persistent), web beacons, pixels, page URL, and timestamp. 

You may provide us with information when you interact with us through email or otherwise when you interact with us. We may retain such information in order to provide you with the Service, and you agree that we may share this information as needed with other users in order to resolve any issues that may arise between you and another user of the Service. 

B. Non-Personal Information.  

“Non-Personal Information” is information which doesn’t identify you and/or anonymous information about you, including but not limited to links and materials posted, enrollment history, purchase history, the type of device you used and its operating system, browser information, the pages accessed most frequently, how pages are used, applications downloaded, search terms entered, when and how you use the Apps, and similar Non-Personal Information. 

Automatically tracking Internet Protocol (IP) addresses is one method of automatically collecting information about your activities online and information volunteered by you. An IP address is a number that is automatically assigned to your device whenever you surf the internet. Further, the Sites and Service may utilize web beacons, pixels, cookies, and other commonly used information gathering tools. Through collecting your IP address, we may be able to approximate your geographic location, however, unless and until this information is paired with your PII, it cannot be used to identify you. If Non-Personal Information is paired to any of your PII, we will treat the Non-Personal Information as if it was PII. 

Part of the purpose of the Sites is to share materials you make available. Anything you publicly post will not be considered PII. 

1. Aggregate Information.  

We may also collect anonymous, non-identifying and aggregate information, such as the website you go to after visiting our Sites. 

1. Financial Information. 

Although it may appear that we collect financial information from you on the Service, such as your credit card number and related information, it is actually collected and processed through a third-party service provider (“Payment Processor”) to process payments for the Service. The Payment Processor may collect financial information such as banking information, credit card number, name, CVV code, and/or Credit Card date of expiration, from you on the Service. We do not hold your financial information. 

Shopify retains and encrypts your financial information in accordance with the Payment Card Industry Data Security Standard (PCI-DSS). Such transaction records are preserved only for the duration required to finalize your purchase, after which they are purged. All direct payment gateways utilized by the Sites comply with the rigorous standards established by the PCI Security Standards Council—a collaborative effort involving brands such as Visa, MasterCard, American Express, and Discover. These PCI-DSS protocols are designed to safeguard the processing of financial information by the Sites and related service providers. 

1. Why Is My Information Being Collected? 

We accept and gather information in an effort to provide better products and services to you. We collect your PII so that we can respond to your requests for information or so that you can be added to our email and SMS lists, we can curate a personalized experience for you with the Services, and for us to process any orders made in connection with the Service, and, to train, develop, and improve the artificial intelligence and/or machine learning models and algorithms that we may create or use (collectively, “Models”). We also collect aggregate information to help us better design the Sites. We collect log information to help us diagnose problems with our servers, administer the Service, calculate usage levels, and otherwise provide services to you. 

1. How Do We Use the Information We Collect? 

A. PII. 

We use the PII you provide for the purposes for which you have submitted it including: 

• Internal Uses. We may use your PII to respond to your inquiries, to fulfill your requests for information, track usage trends, develop and improve the Sites and any related services or offerings, perform research and analytics, compile usage statistics and other data regarding the use of our Sites and Service, ensure the security of the organization and our visitors, and abide by any applicable laws. 

• Personalizing Experience. We may use your PII to craft and personalize your experience with the Service. 

• Creating and Maintaining Your Account. We use your PII to create and maintain an account for you to allow you to make payments and access any other aspect of the Service offered by and related to the Company. 

• Processing Payments. Our Payment Processor uses your PII to transfer funds from your account(s) when you purchase merchandise (“Merchandise”) through our ecommerce store (“Store”). 

• Training AI. As mentioned above, if and when the Service uses artificial intelligence, we may use your PII and your Content to develop and improve the Service, including for the training of the Models that power our Service. 

• Communicating With You About the Service. We may use your PII to send you information about, and notify you of, exclusive offers and provide you information regarding your recent purchases, eligibility for our sponsorship program, and new Merchandise. 

• Sending You Administrative and Promotional Emails. We may use your PII to send you emails or SMS messages to: (a) confirm your account information and your other PII; (b) provide you with information regarding the Service; (c) inform you of changes to this Privacy Policy, our Terms of Service, or our other terms, conditions, or policies; (d) let you know about new or unique Merchandise in our Store, or (e) provide you with information or promotions, or other special events, which may or may not be related to our other services and product, and which may be subject to additional terms and disclosures. 

• Mailing You Something. From time to time, we may send you something relating to the Service via USPS, courier, or another service, including, but not limited to when you purchase Merchandise. 

• Employment Information. We collect and use this information in the event that you provide it to us to be considered for a job posting that we have made, sponsorship opportunities or if you want something delivered to your work address. 

B. Anonymous Information. 

We may use anonymous information that we collect to improve the design and content of our Sites, and to enable us to personalize your internet experience. We also may use this information in the aggregate to analyze how our Sites are used, as well as to offer you programs or services. We may use any anonymous, aggregate information, of which your information may be a part of or the basis of, without restriction. 

1. Do We Share Your Personal Information? 

We will not share your PII except: (a) for the purposes for which you provided it; (b) with your consent; (c) as may be required by law or as we think necessary to protect our organization or others from injury (e.g., in response to a court order or subpoena, in response to a law enforcement agency request, or when we believe that someone is causing, or is about to cause, injury to or interference with the rights or property of another); or (d) with persons or organizations with whom we contract to carry out internal operations or business activities.  

Additionally, we may transfer your PII to a third party, or an actual or potential successor-in-interest, in relation to, or in the event of, an actual or potential merger, acquisition, sale of all or substantially all of our assets, reorganization, bankruptcy, or other change of control. After such disclosure or transfer, the third party or successor in interest may use the information in accordance with applicable law. 

1. How Can You Access and Control Your Information? 

After becoming a user of the Sites, you may revise or edit your contact or delivery information by sending an email to support@selkirk.com or support-asia@selkirk.com. For requests to access your PII that we have collected please send an e-mail to security@selkirk.com. To protect your privacy and security, we will take reasonable steps to help verify your identity before granting access, making corrections or removing your information. For more information on how to exercise your rights, please see Section 13. 

1. How Do We Store and Protect Your Information? 

A. Storage. 

After receiving your PII, we will store it for future use. While we have appropriate safeguards in place, unfortunately, no data transmission over the internet or data storage solution can ever be completely secure. As a result, although we take steps to protect your data, we cannot ensure or warrant the security of any information you transmit to or receive from us or that we store on our or our service providers' systems. 

B. Server Locations. 

If you are visiting the Sites from outside of the USA, you understand that your connection will be through and to servers located in the USA, and the information you provide will be securely stored in our servers and internal systems located within the USA.

1. Security. 

Please note that we protect PII in our possession with strong encryption (at rest and in transit); all data transfers are through secure http protocol, and as such are encrypted. We also restrict access to PII to key employees. Our Payment Processors are fully PCI compliant and encrypt all payment transactions using Secure Socket Layer technology.  

D. Retention.  

We will retain your PII for as long as is reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. We may retain your PII for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. 

We may store our logs and other technical records and any information entered into our Models (if applicable) indefinitely. 

1. How Do We Use Cookies and Other Network Technologies? 

A. Cookies. 

To enhance your online experience with us, our web pages may presently or in the future use “Cookies.” Cookies are text files that our web server may place on your hard disk to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other PII unless you choose to provide this information to us. Once you choose to provide PII, however, this information may be linked to the data stored in the cookie. Although it may be possible to turn off the collection of Cookies through your device or browser, certain features of the Sites may not function properly without the aid of Cookies. 

Our Cookie Preferences notice, which appears upon entering the Sites, provides a complete explanation of how we implement Cookies on the Service. 

B. Third-Party Partner Services.  

Our Sites use Google Analytics, provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 (“Google”). Google Analytics uses Cookies and similar technologies to collect and analyze information about use of the Sites and report on activities and trends. This service may collect information regarding the use of other websites, apps and online resources. You may be able to opt-out of some or all of Google Analytics features by downloading the Google Analytics opt-out browser add-on, available at, https://tools.google.com/dlpage/gaoptout. We also may use third-party web analytics services such as those of Triple Whale (see https://www.triplewhale.com/pages/privacy-notice) and HotJar (see https://www.hotjar.com/legal/policies/privacy/). We disclaim all responsibility for the privacy and data practices of these providers, and you acknowledge that such practices are governed by the respective privacy policies.

1. Pixels. 

The Company or its service providers may also use “pixels,” “web beacons,” “clear GIFs” or similar means (collectively, “Pixels”) in connection with some of our Sites’ pages and HTMLformatted email messages for purposes of, among other things, compiling aggregate statistics about website usage and response rates. A Pixel is an electronic image, often a single pixel (1x1), that is ordinarily not visible to website visitors and may be associated with Cookies on visitors’ hard drives. Pixels allow us and our service providers to count users who have visited certain pages of our Sites, to deliver customized services, and to help determine the effectiveness of promotional or advertising campaigns. When used in HTML-formatted email messages, Pixels can inform the sender of the email whether and when the email has been opened.  

PLEASE NOTE THAT CERTAIN PIXEL PROVIDERS MAY TRANSMIT INFORMATION ABOUT YOU TO UNRELATED THIRD PARTIES.  

As described above, we utilize Cookies and Pixels. Cookies and Pixels that are labeled “strictly necessary” or “essential” are essential for enabling the basic functionalities of the Service. BY 

USING THE SERVICE, YOU CONSENT TO OUR USE OF ESSENTIAL COOKIES AND PIXEL TAGS AS DESCRIBED IN THIS PRIVACY POLICY. Upon creating an account, or upon the first time you use the Service without logging into an account, we will provide you the opportunity to enable or disable non-essential Cookies and Pixels. Disabling non-essential Cookies and Pixels may affect your experience with the Service. You may alter your selection at any time within your account settings.

Each Third Party Partner maintains its own privacy policy with respect to their data practices. We disclaim all responsibility for the privacy and data practices of Third Party Partners, and you acknowledge that their use of your data is subject to each of their respective privacy policies. Certain of our Third Party Partners and affiliates, including without limitation, Amazon, Google, Microsoft, and AvantLink, may place and use cookies or device identifiers to serve interest-based ads based on your use of our Sites or Service across the Internet. While these companies control their own privacy practices, several permit you to opt out of interest-based advertising through your device settings or through resources including the Network Advertising Initiative opt-out page (https://www.networkadvertising.org/managing/opt_out.asp) or the Digital Advertising Alliance opt-out page (https://optout.aboutads.info/).  

 

1. Clickstream Data. 

As you use the internet, you leave a trail of electronic information at each website you visit. This information, which is sometimes referred to as “clickstream data”, can be collected and stored by a website's server. Clickstream data can reveal the type of computer and browsing software you use and the address of the website from which you linked to our Sites. We may use clickstream data as a form of Non-Personal Information to determine how much time visitors spend on each page of our Sites, how visitors navigate through the Sites, and how we may tailor our web pages to better meet the needs of visitors. We may use this information to improve our Sites, Apps, and the Service. 

1. Opt-Out Preference Signal. 

We honor your election to use an Opt-Out Preference Signal. An Opt-Out Preference Signal (“Signal”), or Global Privacy Control, is a simple and easy way for you to automatically exercise your right to opt-out of certain data usages of your PII. If you have enabled a Signal to opt-out of certain usages of your PII either (i) generally and universally; or (ii) particularly with regards to our Sites, we will receive a notification your intention to opt-out of said usages when you use the Service. Upon receiving the Signal notification, we will ask you to confirm your intention to opt out of the certain usages of your PII. Please be aware that for the purposes of this confirmation, we will confirm your location using your IP address. 

F. Do Not Track.  

At present, the Sites do not specifically respond to browser do-not-track signals. 

1. Collection of Information by Others. 

Our Terms of Service document identifies certain third-party websites to which we may provide links, and that you may click on our Sites or in our Service. Please check the privacy policies of these other websites to learn how they collect, use, store and share information that you may submit to them or that they collect. 

1. Children and Young People’s Information.  

We do not knowingly collect any PII from any minors, and we comply with all applicable privacy laws including the GDPR, CCPA, the Children's Online Privacy Protection Act (“COPPA”), associated Federal Trade Commission (“FTC”) rules for collecting PII from minors, and the U.K. GDPR. Please see the FTC's website (www.ftc.gov) for more information. If you have concerns about this Sites, wish to find out if your child has accessed our Services, or wish to remove your child's PII from our servers, please contact us at security@selkirk.com. Our Sites will not knowingly accept PII from anyone under 13 years old in violation of applicable laws, without consent of a parent or guardian. If we discover that a child under the age of 13 has provided PII to us, we will make efforts to delete the child’s PII in accordance with the COPPA. If you believe that your child under 13 has gained access to our Sites without your permission, please contact us at security@selkirk.com. 

1. Text Message and SMS Marketing. 

If you choose, you can provide your mobile phone number to receive text message alerts from us to receive promotions, product announcements, and other marketing information from us. You agree, that by providing your mobile phone number, you expressly consent to receive automated text and SMS marketing messages from us to the mobile phone number that you provide. We may send you these messages from time to time, on a recurring basis, as promotions, announcements, and other marketing information become available. Opting-in or providing your consent to receive these messages is not required in order for you to use the Service generally. 

We may share your mobile phone number with service providers with whom we contract to assist us with the above activities, but we will not share your mobile phone number with third parties for their own marketing purposes without your consent. Text Messages are distributed via third party mobile network providers and, therefore, we cannot control certain factors relating to message delivery. Depending on your mobile carrier, it may not be possible to transmit the text message to you successfully; nor is content available on all carriers. We do not claim or guarantee availability or performance of this service, including liability for transmission delays or message failures. 

At any time, you can opt-out of receiving these messages by replying “STOP” to any such message that we send you.

1. General Privacy Rights and How to Exercise Them. 

You have the following rights with respect to our practices regarding your PII: 

1. The right of access. This is your right to be informed about what Personal Information we are processing, why, and who else the data may be passed to. 

2. The right to correction. This is the right to have your Personal Information corrected or amended if what is held is incorrect in some way. 

3. The right to deletion. Subject to certain exceptions, and limitations, this is the right to have your Personal Information deleted. 

4. The right to data portability. This is the right to ask for your Personal Information to be provided to you in a structured, commonly used, and machine-readable format. 

5. Right to Non-Discrimination. In the event that you exercise one of your rights described in this policy, you will not be discriminated by us in any way, including by the denial of goods or services, providing you a different level of goods or services, or charging you different prices or rates for the goods or services, unless the change in price is reasonably related to the value we receive from your Personal Information. 

6. Right to Opt-Out of the Sale of Your Information. We do not sell your PII (whether “for money” or “something else of value”), but if we did, you would have the right to opt-out of such sales at any time.  

7. Right to Opt-Out of Profiling. You may opt-out of ‘profiling’ (using solely automated processing of PII to make decisions that produce legal or similarly significant effects concerning a consumer). To the extent that the Company engages in ‘profiling’ you have the right to opt out of it. 

8. Right to Opt-Out of Targeted Advertising. You may also be able to opt-out of targeted advertising based on your activity on non-affiliated websites and services. Please be aware, if you do exercise this right, you may still see generic ads on the Sites and targeted ads based on your activity with the Company. 

9. Exercising Your Rights. To exercise any of your rights under applicable privacy laws, please contact us at 1.800.759.4326  or  security@selkirk.com, with “Privacy Rights Request” in the subject line. Please include enough detail for us to locate your file; at a minimum, your name, country/state of residence, email(s), and username(s), if any. Please specify in your request which website or all, if applicable, your request refers to. We will attempt to provide you with the requested information within thirty (30) days of receipt. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note, we may take additional steps to verify your information. 

J. Right to Appeal Any Denial of Your Rights. If we should deny your privacy right request, you may submit an appeal of that determination via email to security@selkirk.com.  In the subject line of your appeal email, please include the file number provided with the initial denial of your privacy right request and the word “APPEAL”. In the body of your appeal email please detail (1) the nature of your request, (2) your state of residence; and (3) your reasoning for why the initial denial should be reversed. In the event we deny your request for appeal, you may be able to file a complaint with the Office of the Attorney General in the State in which you reside, please consult the website of your applicable Attorney’s General for more information. 

1. EEA Privacy Rights.  

If you are currently residing in the EEA and use the Service, the GDPR applies to your Personal Data, and you are a Data Subject. The GDPR requires that we, as a Controller, have a legal basis to process your Personal Data.  

A. Personal Data Processing. 

We process your Personal Data under one or more of the following legal bases:  

• Processing is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;  

• To perform the contract that we are about to enter with you (e.g., our Terms of Service);  

• To comply with a legal obligation; and/or 

• If we have your consent to do so (which you have the right to withdraw at any time).

B. Your Rights. 

In addition to the rights described in Section 13, under the GDPR, as a Data Subject you have the following rights: 

• The right to be informed. This is your right to be informed about what we are processing, why, and who else the data may be passed to. 

• The right to restrict processing. This is the right to ask for a temporary halt to processing of your Personal Data, such as in the case where a dispute or legal case has to be concluded, or the data is being corrected. 

• The right to object. This is the right to object to further processing your Personal Data if such processing is inconsistent with the primary purposes for which it was collected. 

• Rights in relation to automated decision making and profiling. This is the right to not be subject to a decision based solely on automated processing.  

• Right to Judicial Remedy. Notwithstanding anything to the contrary in this Privacy Policy, if you feel that we or one of our processors, if any, have infringed your rights under the GDPR, or that we are otherwise not in compliance with the GDPR with respect to your PII, you may bring a legal proceeding against us in a court (or file a complaint with a supervisory authority) located in the EEA country where you regularly reside.

In the event that we share, or otherwise transfer, PII covered by the GDPR and this Privacy Policy to a third party, or a country outside the EEA and/or UK, as applicable, which does not have an adequacy decision from the European Commission, or similar designation from the Information Commissioner’s Office, or similar regulatory authority (collectively, a “third country”), we will only do so if: (i) that third party, except in cases of government or law enforcement agencies, gives us contractual assurances that it will comply with the GDPR; and (ii) to the extent necessary, have in place a GDPR compliant procedure in place to protect the transfer, e.g. GDPR standard contractual clauses, available here, including any necessary assessments of the applicable third country, and supplemental measures designed to ensure you have essentially equivalent rights and remedies as you would in the EEA.

1. California Consumer Privacy Rights. 

To the extent that the CCPA applies to the Service with respect to your Personal Information, and you currently reside in California, the CCPA provides you, as a Consumer, with certain rights (in addition to those found in Section 13 above, specifically, the rights to be informed, to access, to correction, automated decision making/profiling, and to portability). 

A. Right to Know. 

Consumers have the right to request that we disclose Personal Information we have collected about them in the previous 12 months including, but not limited to, the categories of information collected by us, the source(s) of such information by category, and the purpose for collecting such information. This right may not be exercised more than twice in a 12-month period. In the previous 12 months, we have collected the following categories of Personal Information about consumers: 

• Identifiers. Identifiers can be your name, mailing address, social security number, unique personal identifiers (device identifier, IP Address, Cookies, beacons, pixel tags, mobile ad identifiers), account names, and similar information. We collect the identifiers from the consumers themselves and automatic means; 

• California Customer Records (Cal. Civ. Code §1798.80) (“CCRLPI”). CCRLPI data is largely the same as Identifiers; 

• Commercial Information. Commercial information includes records of personal property, products or services purchased, obtained or considered, or other purchased or consuming histories or tendencies; 

• Geolocation Data. Such geolocation data may include GPS data, approximate physical location, and device location; 

• Employment Information. Such employment information can include your employment history; 

• Internet/Network Activity. Internet Activity Information includes browsing history, Cookies, search history and a consumer’s interaction with a website; and 

• Non-public education information. Information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99). 

• Inferences. Inferences drawn from any other category of Personal Information. 

We collect Personal Information in the above categories from the consumers themselves and by automatic means for the purposes described in this Privacy Policy, and as required to comply with applicable law. We do not collect Sensitive Personal Information as defined by the CCPA.  

B. Right to Know.  

As a Consumer, you also have the right to request that we tell you which of your Personal Information we have disclosed for a business purpose, Sold, and Shared (each, as defined in the CCPA) in the previous 12 months. With respect to Personal Information being disclosed for a business purpose, the consumer shall receive the categories of information disclosed and the types of entities they have been disclosed to. This right may not be exercised more than twice in a 12month period. For Personal Information being Sold or Shared this includes the categories of information being sold and the categories of third parties to whom it is being sold. In the past 12 months, we have disclosed and/or Shared Personal Information falling under the following CCPA categories:  

• Identifiers; 

• CCRLPI; 

• Geolocation Data; 

• Employment Information; 

• Internet/Network Activity; 

• Non-public Education Information; 

• Sensitive Personal Information; and 

• Commercial Information. 

We disclose and Share Personal Information in the preceding categories to the Consumers themselves (or their Parent, if applicable), to other users/third parties as the consumer may direct, and government/law enforcement agencies for the purpose it was provided/provision of Services, to comply with applicable law, and as otherwise described above in this Privacy Policy. 

IN THE PAST 12 MONTHS WE HAVE NOT SOLD, AND DURING THE PERIOD OF TIME WHICH THIS PRIVACY POLICY IS POSTED WE SHALL NOT SELL, THE PERSONAL INFORMATION OF ANY CONSUMER, INCLUDING MINORS UNDER THE AGE OF 16. 

C. Shine the Light. 

California law also allows its residents to request information regarding our disclosures to third parties in the prior calendar year, if any, of their personally identifiable information. To make such a request, please contact us at security@selkirk.com with “Shine the Light” in the subject line. Please include enough detail for us to locate your file; at a minimum, your name, email, and username, if any. We will attempt to provide you with the requested information within 30 days of receipt. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note that this law does not cover all information sharing. Our disclosure to you will only include information covered by the law. 

 

1. Nevada Privacy Rights. 

If you are a Nevada resident, you have the right to opt-out of the “sale” of your “covered information” as such terms are defined in Chapter 603A of the Nevada Revised Statutes (“Nevada Privacy Law” or “NPL”). For the avoidance of doubt, we do not “sell” your “covered information”. Nonetheless, Nevada residents may submit a request to prohibit such sales by contacting us at security@selkirk.com. Additional information on the categories of personal information collected and categories of personal information shared with third parties can be found in this Privacy Policy. If you would like to tell us not to sell your information in the future, please email us at  security@selkirk.com with your name, postal address, telephone number, and email address with “Nevada Do Not Sell” in the subject line. 

1. Texas Privacy Rights. 

If you are a Texas resident (“TX Consumer”) and use the Service, in addition to the rights described in Section 13 above, the Texas Data Privacy Security Act provides you with certain rights regarding your PII. As a TX Consumer, your Right to Delete in Section 13 includes any PII that we hold about you which you have provided to us and that which we have obtained from any other source. We will maintain a record of your deletion request and any minimum data necessary to ensure that your PII remains deleted. 

1. Nebraska Privacy Rights. 

If you are a Nebraska resident (“NE Consumer”) and use the Service, in addition to the rights described in Section 13 above, the Nebraska Data Privacy Act provides you with certain rights regarding your PII. As a NE Consumer, your Right to Delete in Section 13 includes any PII that we hold about you which you have provided to us and that which we have obtained from any other source. We will maintain a record of your deletion request and any minimum data necessary to ensure that your PII remains deleted. 

1. Changes to this Policy 

Because our business needs may change over time, we reserve the right to modify this Privacy 

Policy. If at any time in the future we plan to use your PII in a way that differs from this Privacy 

Policy, we will revise the Privacy Policy as appropriate. In the event of a change to this Privacy Policy, we will email the updated policy to the email address that you provided to us. Your continued use of the Service, or other means of legal acceptance, following our notice of changes to this Privacy Policy means you accept such changes. Please refer to the “Effective Date” above to see when this Policy was last updated.
